Akwa Ibom State Command of NSCDC has taken a giant leap towards securing an executive fiat to enable it prosecute criminal cases in magistrate courts.
This commitment was made when Comdt Eluwade Eluyemi paid a courtesy visit to her lordship, the Chief Judge of Akwa Ibom State, Hon Justice Ekaete F. Obot at her chambers at the judiciary headquarters in Uyo on Monday, 9th October, 2023.
The NSCDC boss informed Justice Obot of the expansive functions and duties of NSCDC as captured in the NSCDC Acts 2003 and 2007, noting that the Command lacks the locus standi to prosecute certain cases in magistrate courts and thus requested that her lordship helps facilitate the issuance of the fiat from the office of the Attorney General of the state.
Comdt Eluwade also requested her lordship's avails the Command of support and counsel whenever it is required especially on legal matters.
In her response, the honourable chief judge of the state promised to speak to the attorney general of the state on the subject matter to help facilitate it.
She went ahead to advise the corps to always take into consideration: the human angle and the place of the law on any issue/ case it is handling.
Justice Ekaete Obot further admonish the corps to carry out enlightenment campaign on its duties as many Nigerians need to know NSCDC core duties, so as know when and what cases to report to NSCDC, amidst perceived overlap of functions.
High point of the meeting was the presentation of the combined NSCDC Act to her lordship.
The State Commandant was accompanied by the head of Legal Unit, Barr. Mathais Ashu and Mejabi Ayo Esq.
